1. Introduction
These Terms and Conditions govern the agreement between Bullstreet Productions Studio (operating as "Bullstrings Recording Ensemble," hereinafter referred to as "The Company," "We," or "Us") and the client ("The Client" or "You"). By booking a recording session, you acknowledge that you have read, understood, and agreed to these terms.
2. Service Description
The Company provides remote string ensemble recording services. The physical recording sessions take place at Foundry Recording Studio (Thessaloniki), utilizing their facilities and engineering staff in collaboration with our musicians.
3. Booking & Payment
Deposit: A non-refundable deposit of [e.g., 50%] is required to secure a recording date and book musicians.
Balance: The remaining balance must be cleared prior to the delivery of the final high-resolution files.
Invoicing: Valid tax invoices will be issued by Bullstreet Productions Studio.
Currency: All transactions are processed in Euros (€).
4. Client Obligations
Materials: The Client must provide finalized sheet music (PDF) and/or reference tracks (MIDI/Audio) at least [48 hours] prior to the session.
Readability: The Company is not responsible for delays or errors caused by illegible or poorly formatted scores provided by the Client.
The Client is responsible for ensuring that all submitted musical materials are technically and musically feasible for performance within the booked recording time. The Company is not responsible for delays or limitations resulting from material that exceeds reasonable performance expectations for a session without rehearsal.
5. Intellectual Property (IP) & Rights
Work for Hire: Upon full payment, The Company assigns all master recording rights of the performed works to The Client.
Usage: The Client is granted the right to use the recordings in perpetuity, worldwide, across all media (films, albums, streaming, broadcast).
Moral Rights: Our musicians waive their rights to claim royalties from the Client’s use of the recording, provided the invoice is paid in full.
Portfolio Rights: Unless a Non-Disclosure Agreement (NDA) is executed, The Company reserves the right to use short excerpts (up to 30 seconds) of the final recording for promotional purposes (website portfolio, social media) after the Client’s project has been publicly released.
6. Cancellation & Rescheduling
Rescheduling: Requests made more than [7 days] before the session will carry the deposit over to the new date.
Cancellation: Cancellations made less than [48 hours] before the session will result in the forfeiture of the deposit to compensate for studio time and musician booking fees.
7. Limitation of Liability
The Company acts as a service provider. While we strive for the highest fidelity, we are not liable for:
Delays caused by force majeure (natural disasters, strikes, power outages).
Artistic dissatisfaction not based on technical faults, unless raised during the agreed revision period.
Musical Complexity & Playability Review
Review Right:
All submitted compositions are subject to a playability and feasibility review by the Company’s conductor and/or ensemble director.
Final Authority:
The determination of whether any musical material is playable and recordable within the Client’s booked session time, without rehearsal, shall rest solely with the Company’s conductor and/or ensemble director.
Unplayable or Impractical Material:
If any piece is deemed, in the Company’s professional judgment, to be unplayable, impractical, or likely to compromise recording quality within the booked time, the Company reserves the right to suspend, modify, or decline recording of that material.
Client Notification & Options:
In such circumstances, the Company will notify the Client and, where feasible, offer one or more of the following options:
Booking additional recording time in increments of 30 minutes
Revising or substituting the musical material
Scheduling a consultation or review meeting
Cancelling the session in accordance with the Cancellation & Rescheduling policy
Pre-Session Review:
While musical material is typically reviewed prior to payment, the Company reserves the right to make final playability determinations on the recording date based on real-time performance conditions.
9. Pricing Structure, Session Type & Time Allocation
Recording Time Definition:
All prices quoted refer to 30-minute units of active recording time within a shared recording session, unless otherwise explicitly agreed in writing.
Shared Sessions:
In shared sessions, multiple clients’ projects may be recorded within the same studio session. The Company retains full discretion over session scheduling and order of recording.
Exclusive Sessions:
Clients requesting an exclusive recording session (i.e., a session reserved solely for the Client’s project) are required to cover the full production cost of the session.
Full production cost includes, but is not limited to:
Musician and player fees
Studio rental and engineering costs
Conductor and/or ensemble director fees
Session coordination and administration
Score preparation and printing
Exclusions:
Quoted prices do not include:
Rehearsal time
Breaks or downtime
Value Added Tax (VAT)
Additional Time:
Recording time exceeding the originally booked duration will be charged in additional 30-minute increments, subject to availability and prior approval.
VAT:
VAT will be applied in accordance with Greek tax law and itemized on the final invoice where applicable.
10. Governing Law
This agreement is governed by Greek Law.
